前言:温州苍南数千民众围观少数暴徒殴打城管一事一如既往的在网上得到一些嗜血的公知和无知的暴民的欢呼。现在网络上流行的论调就是:城管欺凌小贩,遭暴力反抗是正义对邪恶的抗争,城管被打死也是活该。

这种愚蠢的话如果出自一个无知的市斤小民还情有可原,因为他们对于法律知之甚少。但这样的话经常出自一些自称是法律专家,经济学家,自由主义者的“社会精英”口中,这就不得不怀疑这些伪君子到底心里藏着什么邪恶的念头。这些人一方面口口声声声讨“文革”的残暴血腥,一方面操着文革中红卫兵的腔调要用暴力对付他们所称的暴政。正是同一类人,在文革中是造反派,到现在就成了“民主斗士”。他们永远干着同一件事:煽风点火,造谣惑众,唯恐天下不乱。

城管里确实有不少素质低下,横行霸道的人员。这些人只要暴力执法,触犯法律就必须严惩不贷,绝不姑息。同样的,无论任何人,无论他有多少冤屈,有多少道理,只用用暴力手段来对待别人,包括城管、警察、医生和护士,也必须按法律惩处。

这么简单的道理根本无需讨论,无需争论,在一个法制社会中。没有任何暴力是正义的。如果有所谓”正义的暴力“,那么有更多无辜者将受暴力伤害,甚至包括哪些鼓吹”正义暴力“的精英难免自己死于暴力。

OVER the years, conflicts between street peddlers and urban management officials, or Chengguan, have occurred frequently across the country; some have resulted in violent fights with casualties. There is no denying that some disqualified and ill-trained Chengguan employees’ rough law enforcement practices have not only enraged the public, but also tarnished the image of Chengguan as a whole. 

As a result, nearly all the reports — mostly negative — concerning conflicts between Chengguan and peddlers go viral online, and the constant discrediting of the Chengguan has made many believe that the Chengguan are the only party to blame if any violent scuffle arises, since the Chengguan are the strong and peddlers are the weak. There is a dangerously widespread misconception that violence against officials is justifiable and glorious, although violence committed by officials against peddlers is regarded an evil crime. 

Such an erroneous attitude was best exemplified in the case of Xia Junfeng, a street vendor in Shenyang, who was executed on Sept. 25, 2013 for voluntary manslaughter. During a conflict with some Chengguan in May 2009, he stabbed two officers to death and severely wounded another. He claimed he did it out of self-defense and appealed against the decision to sentence him to death. 

Sympathy and support for Xia descended on him, carrying an implicit message: a vendor’s life was priceless while Chengguan officers’ lives were worthless because the former was “the oppressed” and the latter “the oppressor.” 

This absurd fallacy has repeatedly shown its baneful effects on society. The bloody mass incident that took place on April 19 in Lingxi Township, Cangnan County, Wenzhou City, Zhejiang Province, was far beyond “a conflict;” it was a serious violation of rule of law, an unconcealed contempt for social order and a reflection of online rumors’ harmfulness. 

A video clip showed a Chengguan’s violent treatment of a man who was trying to take photos of a Chengguan officer and a peddler in a dispute started the turbulence. But an online rumor that a peddler was beaten to death by the Chengguan fueled the anger of the locals and thousands of local residents ignorant of the facts besieged an official van and began beating up the five employees inside the vehicle, seriously injuring two of them, one of whom is still in critical condition. Online photos revealed the ghastly brutality of the assailants; they kept attacking the already badly injured victims with stones, sticks and fists. 

The nature of the matter should have been self-evident: a few uncivilized Chengguan employees mistreated an innocent citizen and they deserved legal punishment. But online rumors and some irresponsible online bloggers’ inflammatory remarks fanned the flames of violence, hence turning an unfortunate event into mob violence. 

For years, some active online bloggers have played a very inglorious role in creating and exacerbating social unrest. They are trying hard to depict all official institutions such as police and Chengguan as demons, bullying and looting the masses. They are busy gathering and spreading pictures and videos online to show “official atrocity” or “the plight of the masses.” 

Ironically, their often-conflicting attitudes toward violence have betrayed their hypocrisy. They condemn the violent “Cultural Revolution” and what they alleged “official violent treatment of citizens” on the one hand, but they justify and praise violence against officers on the other. One such double-dealer wrote in a Weibo post, “the beating-up of Chengguan was not a lynching, but a brave fight against the tyrannical rule, to which I will say, ‘bravo.’” 

Amid such a distorted social atmosphere, violence has overrun order and law, with cases involving assault and the killing of innocents on a sharp rise. An increasing number of people who claim to be wronged resort to violence. Medical workers are some of the biggest victims. Seemingly encouraged by inflammatory talk, some troublemakers attack doctors or nurses without any reason. 

It’s time to end this mess! We must make it clear: no violence is acceptable. Authorities have vowed to severely punish those who commit criminal conduct that disrupts medical work or the assault of medical workers and damaging hospitals. 

In the Cangnan case, police have detained a dozen assailants as well as three Chengguan employees suspected of committing violence. Anyone who breaks the law or incites breaking the law must be punished. 

Martin Luther King Jr. said, “Nonviolence is the answer to the crucial political and moral questions of our time; the need for mankind to overcome oppression and violence without resorting to oppression and violence.”
